Deacons in the press: Model laws a 'mixed bag'

Tougher due diligence procedures on employers, no union right to prosecute but a more expansive approach to the right of entry of unions on OHS matters, and expanded powers for HSRs are the three key recommendations to come out of the second report of the National Review into Model OHS Laws, reports Occupational Health News, 18 February 2009. Deacons partner Michael Tooma said the tougher NSW-style approach on due diligence was unexpected, with the first report taking a softer line on the issue. On the issue of unions losing the right to prosecute, Michael said the most notable prosecution was by the FSU against a number of banks following armed hold ups, with other prosecutions included against the Dept of Education and Training after an attack by a student, and the Dept of Community Service also following an attack .
